OnApp Limited (“OnApp”) Trademark Use Guidelines
These guidelines apply to all use of OnApp’s trademarks, service marks, logos and get-up (“OnApp Marks”) by any third party (“you”) that is licensed by OnApp (“Permitted OnApp Marks”). If, under the licence you have been granted by or on behalf of OnApp, other guidelines or terms apply to your use of Permitted OnApp Marks, then they will apply in addition to these guidelines. Your licensed use in respect of Permitted OnApp Marks is subject to these guidelines. In the event of any inconsistency between these guidelines and the terms of your licence to use Permitted OnApp Marks, the terms of your licence will prevail.
Your display/depiction of the Permitted OnApp Marks must be identical to the display/depiction of them used by OnApp. You must not use any modified version of any Permitted OnApp Marks, nor any word marks that sound the same as or colourably similar to them or logos that look the same as or colourably similar to them.
When using the Permitted OnApp Marks: (i) you must display, in a reasonably prominent manner, adjacent or very close to their display, a notice that: “[name of Permitted OnApp Mark] is a registered trademark of OnApp Limited”, if it is registered; or, “[name of Permitted OnApp Mark] is a trademark of OnApp Limited”, if it is unregistered. Where your use is within the USA then, additionally, you must apply the correct trademark symbol alongside the Permitted OnApp Mark when it is first displayed in a literary or graphic work.
If you are licensed by OnApp to publicly describe yourself as having a relationship with OnApp (for example, “Authorised Reseller”) you may use the Permitted OnApp Marks for that purpose but only adjacent to the words describing that relationship: for example, “OnApp Authorised Reseller”. If you are licensed by OnApp to publicly describe a relationship between your goods/services and those of OnApp then, your use of the Permitted OnApp Marks must only be to refer to that relationship: for example, “Powered by [name of OnApp solution]” or “Includes [name of OnApp solution]”.
The Permitted OnApp Marks must not form a part of the product name of your goods/services; or be more prominent than the product name of your goods/services. The Permitted OnApp Marks must not be used: (i) in a way that is false or misleading or damaging to OnApp’s goodwill or reputation or that of its goods/services; or (ii) as part of any url.
Your licensed use of the Permitted OnApp Marks does not entitle you to use the whole or any part of any other OnApp Marks. All goodwill arising from your use of Permitted OnApp Marks exclusively inures to the benefit of and belongs to OnApp.
